PROTECT YOUR BRAND WITH TRADEMARKS
Parents should be aware and guide their children about the legal education of branding.
“Branding design is just the beginning. Once you’ve completed the process, it’s important to
legally protect that identity”.
The brand represents your reputation and business in the public eye and a trademark legally
protects those aspects of your brand that are unique and specific to your company. A trademark
is a specific aspect of your brand which has legal protection as it is a unique identifier for you.
Trademarks can be any specific unique words or phrases such as name, labelling, signatures,
slogans, trade dress, logos, specific combinations of colours, shapes and design layout, sounds,
etc,. If a brand is not legally registered, then any other people can use it without fear of penalty.
If the brand is registered, severe penalties attach to its unauthorized use.
(Example) How to Identify your Brand?
Papa: Kids, have you thought about a special name to our
shop?
Kids: I have thought of a special name Papa “AABUSHAN”
for our shop, it’s very unique.
Papa: Okay, the name has now been decided and the mark has to be legally protected. The
trademark “AABUSHAN” helps us to establish a brand or image of our company. It is our mark
which is going to be used on goods or services or other articles of commerce to distinguish it
from other similar goods or services originating from a different undertaking. We can protect
the name of our shop by a trademark. If we sell a certain quality of jewellery, the customers will
automatically link the name of our shop to the jewellery.
In order to claim monopoly over anything as our ‘Trademark’ we should always remember that
it should not be descriptive of the product or service in respect of which we want to use that
trademark; and no one else is using the same or similar thing as his trademark.
